A mortgage inspection is a low-cost drawing prepared for a lender or title company that shows the approximate location of the house and other improvements on a lot, so the lender can confirm the building sits roughly where it should and nothing obvious encroaches. It is not a boundary survey. No corners are set, the property lines shown are usually scaled or computed rather than measured and monumented, and in several states the document is required by rule to carry a disclaimer saying it must not be used to establish fence or building lines. Is a mortgage inspection a legal survey?
In most states, no, and the rules say so directly. Several state surveying boards require the document to be labeled something other than "survey" and to carry mandatory disclaimer language stating that it is not a boundary survey and that no reliance should be placed on it for locating fences, buildings or other improvements. Illinois treats a mortgage inspection as a distinct, lesser product from a plat of survey. Colorado draws the same line between an improvement location certificate and an improvement survey plat. A boundary survey names itself as one, carries the surveyor's seal and a certification statement, shows bearings and distances on every line, and identifies the monument found or set at each corner. A mortgage inspection carries a disclaimer instead. Anything that says "this is not a boundary survey" is telling you the truth, and it is worth reading before you sign.
