What is different in Florida is everything that happens after the flags go in. The boundary is drawn under a state methodology that preempts every local rule, a binding formal determination from your water management district carries a published fee of $777 to $2,119, and the federal permit that used to come from Tallahassee now comes from the Army Corps of Engineers again.

That last change catches owners and builders who did their homework in 2022 and are acting on it in 2026. Florida assumed the Clean Water Act Section 404 program in December 2020, which let a single state agency issue both the state and the federal authorization. Whichever district you are in, the pattern holds: the informal answer is cheap and the binding answer costs several times more, and choosing between them is the real decision.

Formal or informal determination: which one should you pay for?

Florida law gives you two ways to have an agency put its name on your wetland line, and they are not interchangeable. Section 373.421 of the Florida Statutes makes a formal determination binding for up to five years as long as physical conditions on the property do not change, and makes it final agency action. An informal determination is explicitly nonbinding, which means the district can look at the same ground later and reach a different answer.

The practical rule: buy the informal answer during due diligence, when you want to know whether a parcel is worth pursuing at all, and buy the formal one before you spend money that depends on the line staying put. If a lender, a buyer or a plat reviewer has to rely on the boundary, an answer the agency can walk away from is not worth the money you saved. And note the renewal provision, because it is genuinely useful: petition in the last 60 days and the district reissues the same extent at a lower fee, provided conditions have not changed and the methodology has not been amended.

Who issues a wetland permit in Florida now?

The Army Corps of Engineers does, for the federal Section 404 side. EPA approved Florida's assumption of the program in December 2020, and on February 15, 2024 the U.S. District Court for the District of Columbia vacated that approval on Endangered Species Act grounds. The D.C. Circuit affirmed in March 2026, and the Department of Justice petitioned for rehearing in August 2026, so the matter is not finally closed. As things stand, only Michigan, which has run its own program since 1984, and New Jersey, since 1994, administer Section 404 themselves. What that means for your project is sequencing and money. The state Environmental Resource Permit did not go anywhere; it is a separate state authorization under Part IV of Chapter 373, administered by FDEP or your water management district depending on the project. The federal permit is now a second application to a second agency on a second timeline. If your schedule was built on one combined review, add months, and add the Corps pre-application meeting back into the plan.

What does an ERP application cost in Florida?

This is where two Florida projects of identical size get two very different bills, because each water management district sets its own fee schedule. Compare the new individual or conceptual permit fees in the Southwest district against the South Florida district, which covers the Kissimmee basin, the Everglades, Palm Beach, Broward and Miami-Dade.

The Southwest figures are from Rule 40D-1.607 and the South Florida figures are from that district's published permit application fee schedule with an effective date of August 7, 2016, so confirm the current sheet before you write a check. The spread at the top of the table is more than five to one for the same acreage and the same impact. Two other lines in the Southwest schedule are worth knowing: filing an individual or conceptual application electronically takes 25 percent off a processing fee above $250, and the exemption determination at $100 is the cheapest way to find out you never needed the permit at all.

Does a federal delineation work for a Florida permit?

Not automatically, and this is the detail that produces a second field bill. Florida ratified a single statewide delineation methodology in Chapter 62-340 of the Florida Administrative Code, and the statute that ratified it preempts every water management district, regional agency and local government from defining wetlands or writing a delineation method of its own. The upside is uniformity: the boundary is drawn the same way in Escambia County as in Monroe. The catch is that the state method is not the federal 1987 Corps manual with its regional supplement, and a project needing both a state ERP and a federal Section 404 permit can need both methods applied to the same ground.

So ask two questions before you commission anything. Which agency is going to receive this work, and which method does it expect? A consultant who delineates in Florida every week will answer both in a sentence. A consultant who does not may hand you a technically competent federal report that the district sends back. The same question applies to the person who maps the line: a delineation plat filed with a Florida application has to be signed and sealed by a licensed Florida surveyor and mapper, which is a different license from the consultant's credentials.

When do you need a wetland delineation in Florida?

Before you close on land you intend to develop, before a grading or drainage plan touches anything low, before you apply for a plat or a building permit in a county that asks about wetlands, and before you price mitigation. Florida land sells fast and often with a short inspection period, so the informal determination and a desktop screening are usually what fits inside due diligence, with the formal determination ordered once the deal is real.

The order of operations that keeps costs down is consistent. Screen the parcel against the soil survey and the inventory mapping first. Put a consultant in the field second. Have a surveyor locate the flags and draw them against your deed lines third, while the flagging is still standing. Then take that package to the district and, if the design cannot avoid the wetland, to the Corps. Skipping the survey step is the most common false economy, because flagging tape that nobody located is worth nothing six months later, and you will pay for the field day twice.

How long is a Florida wetland determination good for?

A formal determination is binding for a period not to exceed five years, provided physical conditions on the property have not changed in a way that moves the boundary, other than changes authorized by a permit. That five-year window lines up with the federal side, where an approved jurisdictional determination from the Corps is also valid for five years. A delineation report with no agency determination behind it has no legal expiry at all, but most reviewers treat one older than about five years as stale and will want a field check.
